Here is a brief summary of what is actually in the Health Bill.

• Page 16: If you change jobs no one can insure you but the Govt. It prohibits Insurance companies from writing new policies.

• Page 22: Mandates audits of all employers that self-insure!

• Page 29: Admission: your health care will be rationed!

• Page 30: A government committee will decide what treatments and benefits you get (and, unlike an insurer, there will be no appeals process)

• Page 42: The Health Choices Commissioner” will decide health benefits for you. You will have no choice. None.

• Page 50: All non-US citizens, illegal or not, will be provided with free healthcare services.

• Page 58: Every person will be issued a National ID Healthcard .

• Page 59: The federal government will have direct, real-time access to all individual bank accounts for electronic funds transfer.

• Page 65: Taxpayers will subsidize all union retiree and community organizer health plans (read: SEIU, UAW and ACORN)

• Page 72: All private healthcare plans must conform to government rules to participate in a Healthcare Exchange.

• Page 84: All private healthcare plans must participate in the Healthcare Exchange (i.e., total government control of private plans)

• Page 91: Government mandates linguistic infrastructure for services; translation: illegal aliens

• Page 95: The Government will pay ACORN and Americorps to sign up individuals for Government-run Health Care plan.

• Page 102: Those eligible for Medicaid will be automatically enrolled: you have no choice in the matter.

• Page 124: No company can sue the government for price-fixing. No judicial review” is permitted against the government monopoly. Put simply, private insurers will be crushed.

• Page 127: The AMA sold doctors out: the government will set wages..

• Page 145: An employer MUST auto-enroll employees into the government-run public plan. No alternatives.

• Page 126: Employers MUST pay healthcare bills for part-time employees AND their families.

• Page 149: Any employer with a payroll of $400K or more, who does not offer the public option, pays an=2 08% tax on payroll

• Page 150: Any employer with a payroll of $250K-400K or more, who does not offer the public option, pays a 2 to 6% tax on payroll

• Page 167: Any individual who doesnt’ have acceptable healthcare (according to the government) will be taxed 2.5% of income.

• Page 170: Any NON-RESIDENT alien is exempt from individual taxes (Americans will pay for them).

• Page 195: Officers and employees of Government Healthcare Bureaucracy will have access to ALL American financial and personal records.

• Page 203: The tax imposed under this section shall not be treated as tax.” Yes, it really says that.

• Page 239: Bill will reduce physician services for Medicaid. Seniors and the poor most affected.”

• Page 241: Doctors: no matter what speciality you have, you’ll all be paid the same (thanks, AMA!)

• Page 253: Government sets value of doctors’ time, their professional judgment, etc.

• Page 265: Government mandates and controls productivity for private healthcare industries.

• Page 268: Government regulates rental and purchase of power-driven wheelchairs.

• Page 272: Cancer patients: welcome to the wonderful world of rationing!

• Page 280: Hospitals will be penalized for what the government deems preventable re-admissions.

• Page 298: Doctors: if you treat a patient during an initial admission th at results in a readmission, you will be penalized by the government.

• Page 317: Doctors: you are now prohibited for owning and investing in healthcare companies!

• Page 318: Prohibition on hospital expansion. Hospitals cannot expand without government approval.

• Page 321: Hospital expansion hinges on community” input: in other words, yet another payoff for ACORN.

A Lawyer Basket of Goodies

For some time now the federal government has been intensifying its pursuit of what are sometimes known as "Medicare liens" against third party defendants (more). In the simplest scenario "" not the only scenario, as we will see below "" someone is injured in, say, a car accident, and has the resulting medical bills paid by Medicare. They then sue and successfully obtain damages from the other driver. At this point Medicare (i.e. the government) is free to demand that the beneficiary hand over some or all of the settlement to cover the cost of the health care, but under some conditions it is also free to file its own action to recover the medical outlays directly from the negligent driver (who in some circumstances might even wind up paying for the same medical bills twice). It might do this if, for example, it does not expect to get a collectible judgment from the beneficiary.

The newly added language in the Thursday morning version of the health bill (for those following along, it"s Section 1620 on pp. 713-721) would greatly expand the scope of these suits against third parties, while doing something entirely new: allow freelance lawyers to file them on behalf of the government "" without asking permission "" and collect rich bounties if they manage thereby to extract money from the defendants. Lawyers will recognize this as a qui tam procedure, of the sort that has led to a growing body of litigation filed by freelance bounty-hunters against universities, defense contractors and others alleged to have overcharged the government.

Dems Begin the Fight Against Abortion Doors in Health Bill

"Without an explicit exclusion, abortion will [eventually] be determined to be included in [the] benefits standards" by either Congress or the courts, Pitts predicted. He cited the example of Medicaid, which federal courts ruled had to cover abortion services until Congress passed legislation stating otherwise.

Rep. Bart Stupak, D-Michigan, warned that any comprehensive federal health care law would pre-empt individual state decisions regarding abortion services.

ANTI-RATIONING AMENDMENT TO HEALTH CARE BILL DEFEATED 12-10 IN SENATE COMMITTEE
The Senate Health, Education, Labor and Pensions Committee today defeated on a party-line vote an amendment offered by Senator Michael Enzi of Wyoming, the ranking Republican member to the pending health care restructuring bill that would have prevented the use of "comparative effectiveness" research methodologies as a basis for denial of benefits to patients against their will based on their age, expected length of life, or of the patient"s present or predicted disability or quality of life. Senators Enzi, Gregg, Coburn and Burr spoke in favor of the amendment.

"The current sources of funds being considered to pay for health care restructuring are so inadequate in the long term that rationing will be compelled," charged Burke Balch, director of the National Right to Life Committee"s Powell Center for Medical Ethics. "By rejecting the Enzi amendment, the Senate HELP Committee today cleared the way for that rationing to be based on discrimination against people with disabilities, older people, and anyone considered to have a poor "˜quality of life.""

Doctors Flee Health Care Bill

Some doctors charge the bill will lead to inferior patient care as physician offices around the country triple their patient lists and become forced to ration care.

"This is war," Dr. George Watson, a Kansas physician and president-elect of the American Association of Physicians and Surgeons, told FOXNews.com Thursday. "This is a bureaucratic boondoggle to grab control of health care. Everything that has been proposed in the 1,018 page bill will contribute to the ruination of medicine."

Opponents of the bill also charge that it will deter prospective doctors from pursuing a medical degree -- adding to preexisting concerns over the current number of doctors.

Presidential Doctor says "NO" to Health Care Bill

David Scheiner, a Chicago-based doctor, has taken a hard look at the president's prescription for health care reform and sees bad medicine.
"This isn't that kind of health care program that I think is going to work," he said.

Dr. David Scheiner, who was Barack Obama's personal physician for 22 years, doesn't support the president's health care reform plan.

Is Their a Doctor In the House???

In the recently released House health-reform bill, nurse practitioners (and physician's assistants, another relatively new, but smaller, category of medical professionals who can perform medical procedures and often prescribe medication) are listed alongside doctors as primary-care providers. Nurse practitioners lobbied hard for this legislative language in meetings with White House health officials, including Nancy-Ann DeParle, Obama's health-reform czar. The nurse-practitioners lobby is hoping such federal recognition of the central role the profession can play in a revamped health system will exert pressure on states to ease up on restrictions. A patchwork of state laws now dictates how much freedom nurse practitioners have, ranging from states like Alabama, where nurse practitioners can only work under the supervision of a physician, to Oregon, where nurse practitioners are permitted to run their own private practices.

Cold Care: AKA End of Life Care

We spend two-thirds of our valuable resources on the end of life in this country, and it doesn't stop that event from happening. As Kenny Rodgers said a few decades ago, "You gotta know when to hold them. Know when to fold them." As long as we don't recognize that there is a time to live and a time to die.

It's not morbid. It's not sad. It's just what it is, and until we realize that sometimes a peaceful, unmechanized death is much more preferable than a "do everything that you need to do to keep em alive" scenario is, we will continue to squander our precious healthcare dollars on a hopeless journey to the "fountain of youth."

Or, as my old friend, Carl Bombatch used to say, "Everybody wants to go to heaven, but nobody wants to DIE."

Who Will Have the Final Say at the End of the Day???

The Medicare "mandatory counseling" controversy in the Obamacare debate laid bare a realistic fear that compensated counseling under Medicare could easily become subtle (or not so subtle) persuasion to refuse treatment"particularly since the primary point of the clause is to cut costs.

Here is an example of why I believe that the fear is realistic. The Center for Practical Bioethics has published a "Caring Conversations" workbook, in which intimate issues and details of life, death, and end of life options are raised. Nothing wrong with that, in and of itself, of course. It all depends on how it is done.

In this regard, it is worth nothing that workbook contains an advance medical directive that has a default position of refusing life-sustaining treatment and participating in medical experimentation when the person will not be restored to health. These are the boilerplate instructions in the "Healthcare Treatment Directive":

* I always expect to be given care and treatment for pain or discomfort even if such care may affect how I sleep, eat, or breathe.

* I would consent to, and want my agent to consider my participation in federally regulated research related to my disorder or condition.
* I want my doctor to try treatment/interventions on a time -limited basis when the goal is to restore my health or help me experience a life in a way consistent with my values and wishes. I want such treatments/interventions withdrawn when they cannot achieve this goal or become too burdensome for me.
* I want my dying to be as natural as possible. Therefore, I direct that no treatment (including food or water by tube) be given just to keep my body functioning when I have: a condition that will cause me to die soon, or a condition (including brain damage or brain disease) that I have no reasonable hope of achieving a quality of life that is acceptable to me"¦

(Among the "quality of life" examples that are suggested to be listed by the document signer are, able to "take care of myself, able to "feed myself," and able to "be responsive to my environment."

The lexicon of the document is far from neutral and presumes that people will not want their lives sustained if they are in a dependent state. If one disagrees with these default positions, the signer must take action:

If you do not agree with one or the other of the above statements, draw a line through the statement and put your initials at the end of the line.

In the wrong hands, end of life counseling could easily be subtly or overtly outcome directed, as studies have shown often happens with genetic counseling of pregnant women testing positive for a Down fetus. Thus, there is much about which to be concerned when Medicare pays practioners to engage in counseling about end of life, and indeed, authorizes part of the counseling to consist of referrals to outside organizations that might have ideological agendas (such as Compassion and Choices).

Welcome to the 21st Century Of Health Care.
It is not about the people, it is about the $100 trillion dollar forum within. Goverment Officials seek to tax it... .
I once wrote to President Obama and stated to take the words of 250 million people of what Health Care should do for them, and place this before all on tv, remove this force pay concept, the pick and choose the best and dump the rest, all issues that are not of a moral building block of Bill To Law.
But to do this you must step out side of the Artificial Intelligence within Government of what the dollar is next to the needs of a people. It must be known that the tax against the health care system is because it is a $100 trillion dollar package.
